  1. FORCEVISION SOFTWARE LICENSE AGREEMENT

  4. IMPORTANT: THIS SOFTWARE END USER LICENSE AGREEMENT ("EULA") IS A 
  5. LEGAL AGREEMENT BETWEEN YOU (EITHER AN INDIVIDUAL OR AN ENTITY) AND 
  6. DMITRY MALYSHEV. READ IT CAREFULLY BEFORE COMPLETING THE 
  7. INSTALLATION PROCESS AND USING FORCEVISION ("THE SOFTWARE"). IT 
  8. PROVIDES A LICENSE TO USE THE SOFTWARE AND CONTAINS WARRANTY 
  9. INFORMATION AND LIABILITY DISCLAIMERS. BY INSTALLING AND USING THE 
  10. SOFTWARE, YOU ARE CONFIRMING YOUR ACCEPTANCE OF THE SOFTWARE AND 
  11. AGREEING TO BECOME BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO 
  12. NOT AGREE TO BE BOUND BY THESE TERMS, THEN DO NOT INSTALL AND USE 
  13. THE SOFTWARE AND DELETE ALL COPIES OF THE SOFTWARE IN YOUR 
  14. POSSESSION. DMITRY MALYSHEV GRANTS YOU NON-EXCLUSIVE LICENSE TO USE
  15. THE SOFTWARE AS INDICATED HEREIN.

  18. 1. COMMERCIAL AND NON-COMMERCIAL USE
  19.  
  20. ForceVision is distributed as a freeware solely for private, 
  21. non-commercial use. ForceVision is free for personal 
  22. (non-profitable), educational use (schools, colleges, universities)
  23. and for use in charity or humanitarian organizations. If you are 
  24. non-commercial user, omit clause 3 of this EULA. No other 
  25. exceptions are applicable to non-commercial users in this EULA.

  27. To use ForceVision in a commercial organization or in any other 
  28. form of business activity (including sole proprietorship, 
  29. government or municipal organizations etc.), you must obtain a 
  30. license from Dmitry Malyshev or its official subsidiaries. If you 
  31. are a commercial or business user, omit clause 2 of this EULA. No 
  32. other exceptions are applicable to commercial users in this EULA.

  35. 2. THE SOFTWARE USE BY NON-COMMERCIAL USERS

  37. 2.1 LICENSE GRANT FOR NON-COMMERCIAL USERS
  38. You may install and use the Software on as many computers as you 
  39. need, as long as the Software is used for non-commercial purposes 
  40. only by you or by any other user who has an access to the installed
  41. program.

  43. 2.2 RESTRICTIONS FOR NON-COMMERCIAL USERS
  44. You cannot use the Software, installed for private use, to view or
  45. modify files which will be used in any kind of business activity or
  46. to gain a profit. For example, you cannot do you job at home using 
  47. the Software if you do not have a legitimate license for commercial
  48. use.
  49. You are also not allowed: (a) to change, adjust, debug, decompile,
  50. reverse engineer the Software (including its documentation) for any
  51. purpose; (b) to remove or change identification and origin data and
  52. names of the Software; (c) to use icons, images, texts or libraries
  53. separately from the Software (neither in free or in commercial 
  54. projects).

  57. 3. THE SOFTWARE USE BY COMMERCIAL USERS

  59. 3.1 LICENSE GRANT FOR COMMERCIAL USERS
  60. You may install one copy of the program on up to allowed number of
  61. computers according to the number indicated in your license 
  62. btained from Dmitry Malyshev.
  63. You may install the Software on a server(s) as long as you 
  64. guarantee that number of simultaneous users of the program does not
  65. exceed the allowed number indicated in your license.

  67. 3.2 RESTRICTIONS FOR COMMERCIAL USERS
  68. As a commercial or business user you can not use the Software 
  69. without legitimate license obtained from Dmitry Malyshev or its 
  70. official subsidiaries. The license must clearly indicate your 
  71. business name (or name of person) and you must have a written proof
  72. of the license purchase either on paper or in electronic form.
  73. You are also not allowed: (a) to change, adjust, debug, decompile,
  74. reverse engineer the Software (including its documentation) for any
  75. purpose; (b) to remove or change identification and origin data and
  76. names of the Software; (c) to use icons, images, texts or libraries
  77. separately from the Software (neither in free or in commercial 
  78. projects).

  81. 4. SOFTWARE DISTRIBUTION

  83. You are hereby licensed to make as many copies of the Software as 
  84. you wish and distribute it to anyone as long as all files remain 
  85. intact as originally provided by ForceVision website. In other 
  86. words you must distribute the Software in form of original 
  87. installation file and not in any other form.

  89. The press is authorized to distribute it on any cover disk, CD-ROM 
  90. without permission from Dmitry Malyshev.
  91. Software catalogue websites are authorized to distribute it as a 
  92. download file (either hosted or linked to ForceVision website) 
  93. without permission from Dmitry Malyshev.

  95. You are not allowed to sell or gain any other profit or commercial 
  96. benefits from distributing the Software without written permission 
  97. from Dmitry Malyshev.

  99. You are not allowed to include the Software as a part of another 
  100. commercial product without written permission from Dmitry Malyshev.

  103. 5. TERM
  104.  
  105. This EULA is effective until terminated. You may terminate it at 
  106. any time by destroying the Software, together with all copies 
  107. thereof. This EULA will also terminate if you fail to comply with 
  108. any term or condition of this Agreement. Upon such termination, you
  109. agree to destroy the Software, together with all copies thereof.

  112. 6. COPYRIGHT AND OWNERSHIP

  114. This Software, its source code, texts, help files and multimedia
  115. content (icons, images, texts etc.) are proprietary products of 
  116. Dmitry Malyshev and are protected by copyright and other 
  117. intellectual property laws.

  120. 7. DISCLAIMER OF WARRANTIES
  121.  
  122. The Software is supplied "AS IS". Dmitry Malyshev disclaims all 
  123. warranties, expressed or implied, including, without limitation, 
  124. the warranties of merchantability and of fitness for any purpose.
  125. The user must assume the entire risk of using the Software.

  128. 8. DISCLAIMER OF DAMMAGES
  129.  
  130. Dmitry Malyshev assumes no liability for damages, direct or 
  131. consequential, which may result from the use of the Software, even 
  132. if Dmitry Malyshev has been advised of the possibility of such 
  133. damages.
